General Terms and Conditions for Online Sales

I. Subject and scope


    These General Terms and Conditions for Online Sales (hereinafter referred to as “General Terms”) apply to all purchase orders you place on our website.

     

    II. Order process and conclusion of purchase agreement

     

      (1) The product presentation on our Website does not represent an offer but shall be understood as a non-binding invitation for the customer to submit an order;


      (2) By clicking the “Buy now” button, you send us a binding offer for the conclusion of a purchase agreement with All Things Bath regarding the items in your shopping cart (hereinafter referred to as “Order”);

      (3) All Things Bath may, at its discretion, accept or reject the Order. All Things Bath will accept your Order by sending an order confirmation or simply by delivering purchased items to you. Unless otherwise stated, the effective date of the purchase agreement is the date on which All Things Bath confirms by email the acceptance of your Order. In case a product is out of stock, a substitute will be provided of equal or higher value. In case of purchase on advance payment, the purchase agreement is subject to the condition of and shall become binding for All Things Bath only upon receipt of the full payment for the purchase;


      (4) If you place an Order through our Website, the ordering process comprises four steps:
      (1) You select the desired goods;
      (2) You check all items in your shopping cart and apply any necessary changes. You click the “Check out” button to proceed to payment;
      (3) If you have not already done so, you log into your user account with email and password and enter the required customer data for the invoice;
      (4) Finally, on the “Checkout” page, you select the preferred method of payment and confirm your acceptance of the conditions that shall apply to the purchase.

      Here, you can again change the invoice details, check your purchase and return to the cart by clicking “Back to cart”. By clicking “Buy now”, your Order becomes binding.

       

      • With our order confirmation and/or delivery, we will send you a copy of the corresponding Order, including the corresponding invoice, to your email address.


      • Any customer who changes their mind on their purchase or has no valid reason to cancel will not receive a refund, however may receive 80% of the purchase costs by way of refund within 7 days from cancellation. Remainder funds are to be retained by All Things Bath by way of administrative and restock charges. Once shipping docket is created – shipping will not be refunded, please bear in mind while cancelling. 

       

         III. Prices, delivery costs, taxes and duties

         

          (1)  All prices quoted on our Website are in AUD and inclusive of any relevant taxes.

          (2)  Delivery charges are applicable and may vary based on delivery location. Remote areas may incur extra delivery charge, based on delivery partner’s quote. The flat delivery of $15 is not applicable for Tasmania or Regional areas and will be charged at cost. 

          (3)  Any additional custom taxes, duties, fees, imposts, tariffs and charges that may be raised by particular countries or authorities related to the conclusion or execution of your Order shall be borne by you. You shall indemnify and hold harmless All Things Bath for any such payments.

          (4)  In the event of obvious errors on the Website or made in connection with your Order, All Things Bath reserves the right to correct the error and charge you the correct price. In such a situation, we will contact you and offer you the option of purchasing the item at the correct price or cancelling your Order.

          (5)  You can select one of the payments methods described on the Website. All Things Bath reserves the right to exclude or include particular payment methods at any time.

          (6)  Payment can be made by Apple Pay, credit card, Google Pay, Shop Pay or AfterPay. We do not accept AfterPay for Wholesale orders. 

          (7)  In case of payment by credit card, your payment will be executed by our payment service provider using their discrete secure infrastructure.

          (8)  You may not set off any amounts due whatsoever from All Things Bath against amounts due to All Things Bath, unless expressly allowed by mandatory Consumer protection law.

          (9) The price of our products is as quoted on the site from time to time.

          (10) Price includes GST but excludes delivery costs, which will be automatically added (at the cost shown) to the total amount due when you view the items in your shopping basket, and have selected your chosen delivery method.

          (11) Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

          (12) You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. We also carry out a standard pre-authorisation check on your payment card, and products will not be dispatched until this pre-authorisation check has been completed. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

          (13) Wholesale orders will incur the delivery fee at cost quoted by delivery partners. All costs are to be paid upfront in order to allow the production to begin.

           

          IV. Delivery

           

          (1)  All Things Bath will send the confirmation email to the address indicated in your Order.

          (2)  All Things Bath shall deliver the items without delay upon confirmation of your successful payment of the purchase price. All retail orders are dispatched within 3-9 working days and all Wholesale orders are dispatched within 7-14 working days, unless otherwise discussed. Time for delivery shall be prolonged by reasonable periods in case of force majeure or other events for which All Things Bath is not responsible, such as disruptions in operations, strikes, authority measures, or troubles with telecommunications, delays by delivery partners.

          (3)  The items shall remain the property of All Things Bath until all liabilities under the Order have been paid in full, the earlier passing of the risk notwithstanding.

          (4)  Pick up of your item is an option and if selected, must occur within 10 business days at a time suitable to us, otherwise the goods and money paid by you is (at our discretion) considered forfeited.

           

          V. Use of personal information

           

            (1)  To register on the Website, you need to specify a login name and a password. You are responsible for keeping this information correct and up to date.

            (2)  By completing the contact form, you ensure and take full responsibility that the entered data truly identifies you as a natural person or as a representative of the specified organization. If you place an Order on behalf of an organization, you ensure that you have the authority to do so.

            (3)  All Things Bath is not liable for any consequences that may result from incorrect, incomplete, or false information you have entered or from data you have changed subsequent to your Order.

            (4)  Online payment information related to your Order is processed by All Things Bath’s payment service provider. All Things Bath does not receive detailed information (such as your credit card number) from transactions but instead receives information about whether the payment has been performed successfully or not.

            (5)  By placing your Order, you agree that your contact and payment information may be used to process your payment and to execute your Order.

             

            VI. Data protection

             

            (1)  All Things Bath shall take all reasonable measures to keep your personal information confidential and secure.

            (2)  All Things Bath will disclose your personal information to third parties only to the extent necessary to process your payment, to enforce and fulfill the purchase agreement, to comply with legal and administrative obligations, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities.

            (3)  All Things Bath will not disclose your personal information to any third parties for marketing and advertising purposes without your explicit consent

             

            VII. Liability

             

            Unless All Things Bath is proven to have defaulted intentionally or through gross negligence, claims for damages or the rescission of the contract on grounds of late delivery is excluded. All Things Bath’s total liability in any matter arising out of or related to these General Terms is limited to the purchase price.

             

            VIII. Miscellaneous

             

              All Things Bath reserves the right to amend these General Terms without prior written notification. Changes shall apply to your existing purchase agreements only, subject to the conditions that All Things Bath has informed you about the intended changes in writing and that you did not object to the changes within a period of four weeks.

               

              IX. Online store terms

               

              (1) By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state of residence, or that you are the age of majority in your state and you have given us your consent to allow any of your minor dependents to use this site. You may not use this our products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws.) A breach or violation of any of the Terms will result in an immediate termination of your Services.

              (2)  There will be no refund for a simple change of mind, and All Things Bath will not accept any returns in respect of the same.

              (3)  If you, as purchaser, wish to exchange your purchase, then, at its discretion, All Things Bath will agree to the same, in most circumstances, however any postage fee will be paid for in full by you as customer.

               

              X. General Conditions

               

              We reserve the right to refuse service to anyone for any reason at any time. We also reserve the right to disclose the reason for doing so.  

               

              XI. Gift Cards

               

              • Gift cards can be purchased on the website.
              • Expiry of the gift card is one (1) year following the date of purchase.
              • Gift cards are not refundable, transferable or redeemable for cash.
